In the US, recipes cannot be patented or copyrighted. It’s considered just a collection of facts, like driving directions or a phone book. So, if a company wants to protect a recipe, it becomes a ‘trade secret’ – an entirely different field of law.
On the other hand, the package appearance is copyrighted, and designing a similar product to look very similar would (possibly) be a copyright violation. Even without the bioterrorism.
Incidentally, this sort of thing – deliberately spreading a disease in the food supply – is not brand new. There was a wacko religious group in the 1980s that spread salmonella. The CDC quickly tried to blame the retailers, and it wasn’t until a few suspicious workers wouldn’t give up that they figured it out.
